Respectfully Sheweth:
That the petitioner filed a petition under Section 22-A and 22-B of Cr.P.C. for registration of criminal case against accused persons. (Copy of the application is attached as Annexure A)
That this Honourable Court was pleased to dispose off the said application vide order dated 00.00.202 with direction to the respondents, which is reproduced as under.
“The petitioner is directed to submit the petition to the SHO ______ Lahore, who is directed to obtain the same and register a criminal case against the accused person. Under the relevant provisions of law and deal the matter in accordance with law”. (Copy of the order dated 00.0.202 is annexed as Annexure B)
That in pursuance of the orders the petitioner after obtaining certified copy of the order moved an application to the respondent No.1 for registration of the case against the accused persons on 00.00.202 along with certified copy of order, but the respondent no.1 / SHO has flatly refused to register the case. (Application of the petitioner is annexed as Annexure C)
That the respondent No.1 has deliberately and intentionally disobeyed and not complied with the orders of this Honourable Court for which he is liable to be persecuted and penalized under the law.
That the respondent No. 1 is culpable of misconduct and contempt of court for the deliberate violation of the lawful order of this Honorable Court.
That if the application in hand is not accepted and the case is not registered against the culprit, the petitioner will suffer an irreparable loss and injury.
That being aggrieved, the petitioner has no other adequate or efficacious remedy except to invoke the jurisdiction of this Honorable Court to redress the grievance of the petitioner.
PRAYER
